Every business operating within the supply chain should be registered for VAT within each country where they supply taxable goods and services, applying the reverse charge procedure when appropriate. Suppliers must charge VAT on their sales, maintain records of all transactions, and periodically file a return with their local tax authorities; ultimately paying over collected taxes to each government where applicable.

When Is a VAT Filing in the EU Required?

The member states of the European Union have very similar rules governing who is required to register for VAT & how often a VAT filing in the EU is required. Most importantly, if you are engaged in a taxable activity across several member states, you may need to be registered for VAT in each of the affected countries, unless the reverse charge applies or your sales can be reported through the One Stop Shop (OSS).

Special rules apply to businesses that sell digital services or goods to consumers in other EU countries, which can report the VAT through OSS, and to sellers of imported goods in consignments worth up to €150, which can use the Import One Stop Shop (IOSS). OSS returns are filed quarterly and IOSS returns monthly, in both cases by the end of the month following the period.

Filing frequency is set by each country's rules and often depends on your taxable turnover, not on how often you make sales. Each national authority publishes specific return frequencies; typically ranging from monthly to annual filings.

When Do You Need To Register For A VAT Identification Number In The European Union?

If your business makes taxable supplies within the EU, you may need to register for VAT in the member state where each supply takes place; non-EU businesses have no registration threshold, but B2B sales are often covered by the reverse charge and B2C distance sales can be reported through OSS or IOSS.

If your business does not make any taxable supply within the EU, you do not need to register for VAT or file a tax return with local authorities.

Who Is Eligible To Register For A VAT Identification Number In The European Union?

In short, every business that makes taxable supplies in the European Union needs to check where those supplies are taxed and whether a local VAT registration, an OSS or IOSS registration, or the reverse charge applies.
